1. Acceptance of Terms

Welcome to DreamPixel AI ("DreamPixel", "we", "us", or "our"). By downloading, accessing, or using our iOS mobile application (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

We reserve the right to modify these Terms at any time. Changes will be effective upon posting. Your continued use of the App after changes constitutes acceptance of the modified Terms.

No Tolerance Policy: By using the App, you agree there is no tolerance for objectionable content or abusive users on DreamPixel AI. “Objectionable content” includes, without limitation, illegal, harmful, exploitative, hateful, harassing, or infringing material as described in Sections 4, 8, and 10A.

2. Eligibility

You must be at least 16 years old to use the App. By using the App, you represent and warrant that:

You are at least 16 years of age (or the minimum age required in your jurisdiction)
You have the legal capacity to enter into these Terms
You will comply with all applicable laws and regulations
All information you provide is accurate and current

3. License to Use the App

Grant of License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control for your personal, non-commercial use.

Restrictions: You may not:

Copy, modify, or create derivative works of the App
Reverse engineer, decompile, or disassemble the App
Rent, lease, sell, sublicense, or transfer the App
Remove, alter, or obscure any proprietary notices
Use the App for any illegal or unauthorized purpose
Use the App to compete with or harm our business

4. AI Image Generation Services

Service Description: The App provides AI-powered image and video generation services powered by third-party models (including but not limited to Flux, Ideogram, and Stability AI) via Replicate infrastructure. We also use Firebase (authentication, database, storage, analytics) and Google Analytics for app/site analytics. The App stores your prompts and generated images/videos to provide features such as history, re-use, and community feeds.

Usage Limitations:

Free tier users receive limited generation credits
Paid subscribers receive enhanced features and additional credits
We may implement rate limits and usage restrictions
Service availability is not guaranteed and may be interrupted

Content Restrictions: You agree not to generate:

Illegal, harmful, threatening, abusive, or hateful content
Child sexual abuse material (CSAM) or content exploiting minors
Non-consensual intimate imagery or deepfakes
Content that violates third-party intellectual property rights
Spam, malware, or phishing content
Biometric identification or surveillance applications
Content for deceptive or fraudulent purposes
Content used to train competing AI models

Enforcement: Violations may lead to immediate removal of content, suspension or termination of your account, and reporting to authorities where required. See Section 10A.

5. User Content & Intellectual Property

Your Content: You retain ownership of your prompts, uploaded images, and any original creative input ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, process, and display Your Content solely to provide and improve the Services.

Generated Content: Ownership and permitted uses of AI-generated images and videos ("Generated Content") may be subject to the terms of the underlying AI model providers. You are granted a license to use Generated Content for personal and commercial purposes, subject to model-specific restrictions displayed in-app.

Our IP: The App, including its design, code, features, branding, and all related intellectual property, is owned by DreamPixel AI and protected by copyright, trademark, and other laws.

Community Feeds: By marking content for public display ("showInFeeds"), you grant us a perpetual, worldwide, royalty-free license to display, distribute, and promote such content.

6. Subscriptions & Payments

In-App Purchases: The App offers subscription plans and credit packs available through Apple's In-App Purchase system. All payments are processed by Apple, and you agree to Apple's payment terms. DreamPixel uses RevenueCat to manage subscription entitlements.

Subscription Terms:

Subscriptions auto-renew unless cancelled 24 hours before the end of the current period
You will be charged through your Apple ID account
Manage subscriptions in your Apple ID account settings
Entitlements are managed via RevenueCat

Refunds: Refund requests are handled by Apple per their refund policy. We do not provide direct refunds. Contact Apple Support for refund requests.

Price Changes: We may change subscription prices with advance notice. Existing subscriptions are adjusted at the next renewal.

7. Account & Security

You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access
Ensuring your account information is accurate and current

We may suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

8. Acceptable Use Policy

You agree to use the App in compliance with all applicable laws and not to:

Violate any person's legal rights (privacy, publicity, IP, etc.)
Engage in fraudulent, deceptive, or manipulative practices
Interfere with or disrupt the App's functionality
Attempt to gain unauthorized access to our systems
Use automated tools (bots, scrapers) without permission
Harass, abuse, or harm other users
Upload viruses, malware, or malicious code
Resell or redistribute our Services without authorization

You acknowledge our no-tolerance policy for objectionable content and abusive users and agree to use the Report and Block tools rather than engaging with abusive users. See Section 10A.

9. Third-Party Services

The App integrates with third-party services, including:

Replicate: AI model inference infrastructure (hosted execution of open models)
Firebase (Google): Authentication, database, storage, analytics
RevenueCat: Subscription management
Apple: Payment processing and app distribution
Google Analytics: Website/App analytics

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services or their terms.

9A. Model Providers & Additional Terms

When you choose certain models, additional restrictions from the model provider may apply (shown in-app). Examples include: Black Forest Labs (Flux)—no military/surveillance/biometric uses; export controls; do not use outputs to build a competing service. Ideogram—no misleading AI outputs; no abusive/illegal content; no derivative works of their tech. Stability (commercial models)—no redistribution of model code/weights. Using a model signifies your agreement to its terms.

10. Content Moderation

We may monitor (automatically and/or manually) and review user-generated content to enforce these Terms. We may remove content that violates these Terms, suspend or terminate accounts for violations, report illegal content to authorities, and use automated systems to detect prohibited content. We are not obligated to monitor content but may do so to enforce these Terms and comply with legal obligations.

10A. User-Generated Content (UGC) Safety & Enforcement

Reporting: Use the in-app Report button on posts/profiles or email abuse@dreampixel-ai.com with links/screenshots.

Response Time: We review and act on reports within 24 hours, which may include removal/disablement of content and restriction or termination of the offending account.

Blocking & Mute: You can block or mute other users to prevent further contact or visibility of their content.

Zero Tolerance: We enforce a no-tolerance policy for objectionable content and abusive behavior as defined in Sections 4 and 8.

Repeat Violations: Repeat or severe violations may result in immediate ejection and permanent termination.

Preservation & Cooperation: We may preserve content and account data as required to investigate abuse and to cooperate with law enforcement.

Appeals: If you believe enforcement was in error, contact appeals@dreampixel-ai.com within 14 days; we will review and respond.

11. Disclaimers

AS-IS Service: THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

AI Limitations: AI-generated content may contain errors, biases, or inaccuracies. We do not guarantee the quality, accuracy, or suitability of Generated Content for any purpose.

No Guarantee: We do not guarantee that:

The App will be uninterrupted, secure, or error-free
Results or outputs will meet your expectations
All features will always be available
Data will not be lost or corrupted

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DREAMPIXEL AI SHALL NOT BE LIABLE FOR:

INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
LOST PROFITS, DATA, OR BUSINESS OPPORTUNITIES
DAMAGES RESULTING FROM USE OR INABILITY TO USE THE APP
DAMAGES CAUSED BY THIRD-PARTY SERVICES OR CONTENT

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 (WHICHEVER IS GREATER).

13. Indemnification

You agree to indemnify, defend, and hold harmless DreamPixel AI, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

Your use or misuse of the App
Your violation of these Terms
Your violation of any third-party rights
Your Content or Generated Content
Your breach of applicable laws

14. Termination

By You: You may stop using the App at any time. Cancel subscriptions through your Apple ID account settings.

By Us: We may suspend or terminate your access immediately if you:

Violate these Terms or our Acceptable Use Policy
Engage in fraudulent or illegal activity
Pose a security or legal risk
Fail to pay applicable fees
Post or facilitate objectionable content or abusive behavior (see Sections 4, 8, and 10A)

Effects of Termination: Upon termination, your license to use the App ends. We may delete your data per our Privacy Policy. Provisions that should survive termination (IP rights, disclaimers, liability) will remain in effect.

15. Privacy & Data

Your use of the App is subject to our Privacy Policy, which explains how we collect, use, and protect your information, including storing prompts and generated images/videos, and the use of Replicate, Firebase, RevenueCat, and Google Analytics. By using the App, you consent to our data practices as described in the Privacy Policy.

16. Changes to the App

We reserve the right to:

Modify, update, or discontinue features
Change pricing or subscription plans
Implement usage limits or restrictions
Discontinue the App entirely with reasonable notice

We will notify you of material changes via in-app notification or email.

17. Governing Law & Disputes

Governing Law: These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.

Dispute Resolution: Any disputes shall first be resolved through good-faith negotiation. If unresolved within 30 days, disputes may be submitted to binding arbitration or small claims court.

Class Action Waiver: You agree to resolve disputes on an individual basis and waive any right to participate in class actions or collective proceedings.

18. Export Compliance

You agree to comply with all applicable export and import laws. You may not use the App if you are located in a country embargoed by the United States or are on any U.S. government restricted parties list.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
